Privacy policy for the app “WinTec Crop Protection Docs”

Please contact this address with any questions about data protection. We have not appointed a data protection officer, as the legal requirements under Section 38 BDSG (German Federal Data Protection Act) are not met.
2. Overview
The app records crop protection treatments on the device. The plant protection product, data sheet and BBCH databases are shipped with the app and read on the device. The app does not require a user account, does not use any analytics, advertising or tracking services and does not transmit any data to us. For the map, the address and the field details it retrieves data from the services listed below.
3. Location
With your permission the app reads the device location to centre the map on your position. The location is only read while the app is in use, never in the background. The legal basis is your consent (Art. 6(1)(a) GDPR), which you give via the operating system's permission prompt and can withdraw there at any time. Without permission you can move the map by hand; the app remains usable.
4. External services
Data is only retrieved when you use the respective function. For technical reasons each provider receives your IP address, and beyond that only the data listed here. No names, operators or products are transmitted. The legal basis is Art. 6(1)(b) GDPR, as the retrieval is necessary to provide the function you have called up.

The privacy policies of the respective providers apply to the processing on their side. Map tiles that have already been loaded are cached on the device.
5. Data on your device
The app's private storage holds: the names of operators you entered (to choose them next time), field sizes you corrected per FLIK, crops you chose for fields without a declared crop, the last determined location (so the map starts there next time), the emergency authorisations last retrieved, the map cache and the generated record files. Other apps have no access. The data remains until the app is uninstalled or you clear the app storage in the device settings.
6. Sharing a record
“Share record” passes the treatment record (PDF) and the data set to the JKI data standard (JSON) to an app of your choice, such as e-mail or cloud storage. They contain the operator, the location with coordinates and FLIK, the crop and the products. This only happens on your explicit action; the terms of the chosen app apply to any further processing.
7. Distribution via app stores
The app is distributed via Google Play and the Apple App Store. The respective store operator is responsible for the data processed in that context, such as your store account and purchase and installation records: Google Ireland Limited (Google Privacy Policy) or Apple Distribution International Ltd. (Apple Privacy Policy). We do not receive any data from the stores that would allow us to identify you personally.
8. Device backup
Depending on your device settings, the data stored in the app may be included in the operating system's device backup (on Android the Google backup, on iOS iCloud or a local backup). You control this backup yourself in your device settings; we have no access to it.
9. Your rights
You have the right at any time to
- access the data we hold about you (Art. 15 GDPR),
- have inaccurate data rectified (Art. 16 GDPR),
- have data erased (Art. 17 GDPR) and restrict processing (Art. 18 GDPR),
- data portability (Art. 20 GDPR),
- object to processing based on legitimate interests (Art. 21 GDPR) and
- withdraw any consent you have given, with effect for the future (Art. 7(3) GDPR).
You may also lodge a complaint with a data protection supervisory authority, for example the authority responsible for us, the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia (www.ldi.nrw.de).
As we do not receive any personal data from the app, the stored information is held on your device only. You can delete it there at any time, for example via “Clear storage” or by uninstalling the app.
