Privacy policy for the app “WinTec Gelbschale” (WinTec Yellow Trap)

Please contact this address with any questions about data protection. We have not appointed a data protection officer, as the legal requirements under Section 38 BDSG (German Federal Data Protection Act) are not met.
2. Overview
The app counts pests on photos of yellow traps. It does not require a user account and contains no advertising, no advertising or device identifiers, no analytics or tracking tools and no crash reporting; it does not track you across other apps or websites. Photos, counts and locations stay on your device. The only thing the app loads from the internet is map tiles from the map service Esri. We only receive training images if you send them to us by e-mail yourself.
3. Data on your device
The app stores in its own storage area: photos of yellow traps, the check images made from them, counts, trap IDs, field names, notes, report locations, your chosen map standpoint and training images. Photos are analysed on the device. This data is not transferred to us or to third parties; we have no access to it.
You can delete individual analyses in the app; uninstalling the app removes all of its data from the device. On Android, automatic cloud backup is switched off for the app. On iOS, app data may be included in your iCloud or computer backup of the device, depending on your device settings; you control this backup yourself and we have no access to it.
4. Permissions
- Camera: to photograph the yellow trap.
- Photos: to pick an existing image. Via the operating system’s picker the app only receives the image you select.
- Location: to place a report correctly on the map and to centre the map on your surroundings. The location is only requested while you use the app and is used and stored on the device only.
You grant permissions via the operating system’s prompt (Art. 6(1)(a) GDPR) and can revoke them there at any time. The app keeps working without location; you can also enter coordinates by hand or leave them out.
5. Map service (Esri)
For the map, the app loads map tiles (street map and imagery) from servers of Esri Inc., 380 New York Street, Redlands, CA 92373, USA. For technical reasons Esri receives your IP address, device and web-view details, and the coordinates of the requested tiles, i.e. the map section you are viewing. The app does not send trap data, photos or counts to Esri.
The legal basis is our legitimate interest in a working map display (Art. 6(1)(f) GDPR). Processing may take place in the USA. Esri’s privacy information: esri.com/privacy.
6. Training images by e-mail
Under “Image analyses” you can send training images to us. The app packs them into a zip file and opens your e-mail app with a prepared message to info@wintec.at. Nothing is sent until you send the e-mail yourself.
We then receive your e-mail address and, where your e-mail app includes it, your name, plus the contents of the zip file: image sections of yellow traps, the frames and species you set, date and trap ID. The zip file contains no locations.
We use the images to train and improve the app’s recognition model, and your e-mail address to reply to questions. The legal basis is your consent by sending (Art. 6(1)(a) GDPR), which you can withdraw at any time by e-mail. We keep the e-mail until withdrawal; the images remain part of the training material until you ask for their deletion.
7. Connections to trap manufacturers
If you enter credentials for a trap or data service in the app (such as METOS, Trapview, Semios or Agrio), the app fetches your data directly from that provider. Credentials are kept in the device’s protected storage and sent only to that provider, never to us. Processing there is governed by that provider’s privacy policy.
8. Distribution via app stores
The app is distributed via Google Play and the Apple App Store. The respective store operator is responsible for the data processed in that context, such as your store account and purchase and installation records: Google Ireland Limited (Google Privacy Policy) or Apple Distribution International Ltd. (Apple Privacy Policy). We do not receive any data from the stores that would allow us to identify you personally.
9. Your rights
You have the right at any time to
- access the data we hold about you (Art. 15 GDPR),
- have inaccurate data rectified (Art. 16 GDPR),
- have data erased (Art. 17 GDPR) and restrict processing (Art. 18 GDPR),
- data portability (Art. 20 GDPR),
- object to processing based on legitimate interests (Art. 21 GDPR) and
- withdraw any consent you have given, with effect for the future (Art. 7(3) GDPR).
You may also lodge a complaint with a data protection supervisory authority, for example the authority responsible for us, the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia (www.ldi.nrw.de).
We only receive personal data from the app if you send us training images by e-mail. All other data stays on your device; you can delete it there individually or by uninstalling the app.
10. Changes
If the app changes in a way that affects how it processes data, we will update this policy. The version published here applies.
